Terms and Conditions
1. Introduction
These Terms & Conditions (“Terms”) govern your use of FlowAway (“we”, “us”, or “our”), a digital platform that connects users with independent yoga instructors across Europe for booking yoga sessions. By using our platform, you agree to be bound by these Terms.
2. Scope of Our Service
We provide an online marketplace where users can discover and book yoga sessions provided by independent instructors.
We do not offer yoga services ourselves. The yoga sessions available on our platform are provided solely by third-party instructors (“Hosts”), who operate independently.
We facilitate bookings, manage payments, and promote listings, but we are not a party to the yoga service agreement between the User and the Host.
3. Definitions
“User”: Anyone using the platform to browse or book yoga sessions.
“Host”: Independent yoga teacher offering sessions through our platform.
“Session”: Any yoga class or event listed and booked via the platform.
“Platform”: The digital product (website, app, tools) we provide.
4. Account & Bookings
Users can browse freely but must sign up with their email and provide advance payment to book a session.
Users agree to provide accurate information and keep credentials secure.
Hosts are responsible for the accuracy of their session descriptions and schedules.
By booking a session, you enter into a direct agreement with the Host.
5. Our Role
We act as a marketplace facilitator, not as a yoga service provider.
We collect payments on behalf of the Host and forward it after deducting applicable platform fees.
We do not supervise, control, or guarantee the quality or safety of any session.
We are not responsible for any injuries, cancellations, or dissatisfaction with the Host’s services.
6. Instructor Responsibilities
Hosts must comply with all applicable legal, tax, and insurance requirements.
Hosts are responsible for ensuring the safety and appropriateness of their offerings.
Hosts agree to honor bookings made through the platform and handle their sessions professionally.
7. Prices & Payments
Session prices are set by Hosts or in collaboration with us.
Payments are processed securely via third-party payment providers (e.g. Stripe).
We charge a platform fee to grow FlowAway sustainably – improving the service of its users – which is deducted from the Host’s payout.
Users are charged the full session amount at the time of booking.
8. Cancellations & Refunds
Minimum of 3 participants required
Our sessions require a minimum number of participants (usually 3) in order to take place. If the minimum number is not reached, we or the Instructor reserve the right to cancel the session up to 2 hours before the scheduled start time. In such cases, Users will be notified and receive a full refund to the original payment method.
Flexible cancellation for users
Users may cancel until the evening before the session (midnight, local time) for a full refund.
No refund if cancelled on the same day. However, in exceptional cases an individual solution can be granted – message info@flowaway.org.
Hosts may set their own stricter policies (to be shown clearly in their listings).
9. Liability & Disclaimers
We are not liable for injuries, property damage, or other incidents during sessions.
We make no guarantees about the availability, fitness, or outcome of any session.
Users participate in sessions at their own risk.
Our liability is limited to intentional misconduct or gross negligence.
10. Intellectual Property
All content on the platform (texts, logos, images) is owned or licensed by us.
Hosts grant us the right to use their submitted content for marketing and promotional purposes.
11. Data Protection
We process personal data in accordance with the Privacy Policy and the GDPR.
Data is only shared with Hosts for the purpose of fulfilling bookings.
12. Changes to the Terms
We may update these Terms. Users will be informed via email or platform notification.
Continued use of the platform constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany.
Jurisdiction: Nürnberg.
