Terms and Conditions

1. Introduction

‍These Terms & Conditions (“Terms”) govern your use of FlowAway (“we”, “us”, or “our”), a digital platform that connects users with independent yoga teachers, wellness facilitators, and movement coaches across Europe for booking yoga, wellness, and movement sessions. By using our platform, you agree to be bound by these Terms.

2. Scope of Our Service

‍We provide an online marketplace where users can discover and book yoga sessions provided by independent instructors.
‍
We do not offer yoga, wellness or movement services ourselves. The sessions available on our platform are provided solely by third-party teachers (“Teachers”), who operate independently. We facilitate bookings, manage payments, and promote listings, but we are not a party to the service agreement between the User and the Teacher.

3. Definitions
- “User” – Anyone using the platform to browse or book sessions.
- “Teacher” – An independent yoga teacher, wellness facilitator, or movement coach offering sessions through our platform.
- “Session” – Any class, workshop, course, retreat, private session, or event listed and booked via the platform. This includes both in-person and online formats.
- “Platform” – The digital product (website, tools, and related services) we provide.
- "Bundle" – A pre-paid package of multiple session credits (e.g., 5x or 10x), purchased at a fixed price and redeemed via a code at checkout.
- "Course" – A series of sessions sold together as a fixed package, typically with set dates.

4. Account & Bookings

‍Users can browse the platform freely. To book a session, Users must provide their name and email address and complete payment. Account creation is not required.

Users agree to provide accurate information. Teachers are responsible for the accuracy of their session descriptions, schedules and pricing.

By booking a session, you enter into a direct agreement with the Teacher. FlowAway acts as an intermediary facilitating the booking and payment, not as a party to this agreement.

5. Our Role

‍We act as a marketplace facilitator, not as a yoga, wellness or movement service provider. We collect payments on behalf of the Teacher and forward the Teacher's share after deducting applicable platform fees.

We do not supervise, control, or guarantee the quality, safety or suitability of any session. We are not responsible for any injuries, cancellations, or dissatisfaction with the Teacher's services.

6. Teacher Responsibilities

‍Teachers must comply with all applicable legal, tax, and insurance requirements in their country of operation. Teachers are responsible for ensuring the safety and appropriateness of their offerings.

Teachers agree to:

- Honor bookings made through the platform and handle their sessions professionally.
- Keep their session details, schedules, and availability up to date.
- Clearly communicate their cancellation policy on their listing.
- Comply with applicable data protection regulations when handling participant information shared for the purpose of fulfilling a session.

7. Prices & Payments

Session pricing
‍Session prices are set by Teachers. FlowAway does not set or approve session prices.

Teachers may offer various pricing options, including but not limited to:
- Standard fixed pricing
- Pay-What-You-Can (PWYW) pricing, where the User enters an amount of their choice
- Social-priced or discounted rates via promotional codes
- Bundle packages (see Section 7a)

Payment processing
Payments are processed securely via third-party payment providers (e.g. Stripe, PayPal). Users are charged the full session amount at the time of booking.

Platform fee
We charge a platform fee (commission) on each booking, which is deducted from the Teacher's payout. The applicable fee rate is communicated to Teachers upon onboarding and may be updated with reasonable notice.

7a. Bundles & Voucher Codes
‍
Teachers may offer bundles – pre-paid packages of multiple session credits at a discounted rate.

- Bundles are purchased as a single payment. The User receives a redemption code to apply at checkout for each subsequent session.
- Bundles are non-transferable unless otherwise stated by the Teacher.
- Bundles do not expire unless an expiry date is explicitly stated at the time of purchase.
- If a Teacher leaves the platform while a User holds unredeemed bundle credits, FlowAway will make reasonable efforts to arrange a refund or alternative solution for the remaining credits. FlowAway's liability in such cases is limited to the value of unredeemed credits.
- The platform fee applies to the total bundle purchase price.

8. Cancellations & Refunds

Teacher cancellation policies
Each Teacher sets their own cancellation policy, which is displayed on their session listing. Users are responsible for reviewing the applicable cancellation policy before booking.

If a Teacher has not set a specific cancellation policy, Users may cancel up to 24 hours before the session start time for a full refund.

Minimum participants
Some sessions may require a minimum number of participants to take place. If the minimum is not reached, the Teacher or FlowAway may cancel the session in advance. In such cases, Users will be notified and receive a full refund to the original payment method.

Refund options
Where a refund is due (based on the Teacher's cancellation policy or a session cancellation by the Teacher), Users will receive either:
- A full refund to the original payment method, or
- A voucher code for a future session of equal value.
The refund method may depend on the circumstances and will be communicated to the User.

Same-day cancellations
Cancellations that fall outside the Teacher's cancellation window are generally not eligible for a refund. In exceptional circumstances, Users may contact info@flowaway.org for an individual resolution.

Course and workshop cancellations
For courses and workshops, the Teacher's specific cancellation terms apply. These may differ from their standard drop-in cancellation policy and will be stated on the listing.

9. Payouts to Teachers

FlowAway collects payments on behalf of Teachers and pays out the session amount minus the platform fee.
- Payouts are processed regularly, typically twice per month.
- Payout method and frequency may vary and will be communicated to Teachers during onboarding.
- FlowAway reserves the right to withhold payouts in the event of a dispute, suspected fraud, or a pending refund request, until the matter is resolved.
- Teachers are responsible for providing accurate payment information. FlowAway is not liable for delays caused by incorrect payment details.

10. Online Sessions
Some sessions may be offered online via video call.
- FlowAway generates and provides the video session link to both the Teacher and the User(s). Teachers do not need to create or manage their own video links – they can technically user their own video call tools/set-up, though.
- While FlowAway may facilitate the video connection, we are not liable for technical issues beyond our reasonable control, including internet connection failures, audio/video quality on the participant's or Teacher's end, or third-party platform outages.
- Teachers are responsible for delivering a professional online experience, including adequate audio quality, appropriate lighting, and a suitable teaching environment.
- Recording of online sessions by either party is prohibited unless all participants have given explicit consent.
- Users participate in online sessions at their own risk, including with regard to the suitability of the exercises for their physical condition.

11. Liability & Disclaimers
- We are not liable for injuries, property damage, or other incidents during sessions – whether in-person or online.
- We make no guarantees about the availability, fitness, or outcome of any session.
- Users participate in sessions at their own risk and should consult a medical professional if they have health concerns before participating.
- Our liability is limited to cases of intentional misconduct or gross negligence on the part of FlowAway.
- FlowAway's total financial liability in connection with any booking shall not exceed the amount paid by the User for that booking.

12. Intellectual Property
‍All content on the platform (texts, logos, design, images) that is created by FlowAway is owned by or licensed to us.

Teachers grant FlowAway a non-exclusive, royalty-free licence to use their submitted content (including profile photos, session images, and descriptions) for the purpose of operating, marketing, and promoting the platform. This licence continues for a reasonable period after the Teacher leaves the platform to allow for the removal of materials, but FlowAway will make reasonable efforts to remove Teacher content upon request within 30 days.

13. Data Protection
We process personal data in accordance with our Privacy Policy and the EU General Data Protection Regulation (GDPR). User data is shared with Teachers only to the extent necessary for fulfilling bookings (e.g., name and email for session attendance). Teachers must handle this data in compliance with applicable data protection laws. We may use AI-assisted tools to process support requests. Details are provided in our Privacy Policy.

14. Changes to the Terms
‍We may update these Terms from time to time. Users and Teachers will be informed of material changes via email or platform notification. Continued use of the platform after notification constitutes acceptance of the updated Terms.

15. Governing Law
‍These Terms are governed by the laws of the Federal Republic of Germany.
